Terms of Service

1. General provisions
These Terms of Service (the "Terms") govern the use of the website and services of vpn.how (the "Service") and form an agreement between the Service and any person using the website or the services ("User", "you").
By registering, paying for or using the services you confirm that you have read, understood and fully accept these Terms. If you do not agree with any part of them, do not use the Service.
These Terms apply together with the Public Offer (commercial terms: scope of service, payment, renewal, refunds) and the Privacy Policy (data processing). On commercial matters the Public Offer prevails.
2. What the Service provides
The Service rents you a personal virtual server with pre-installed VPN software and a dedicated IP address. The server is allocated to a single User: the IP address is not shared with other customers of the Service.
- access is granted for the period you have paid for;
- the list of available connection protocols is published on the website and may change as the Service evolves;
- you manage the server (credentials, configurations, password change, renewal) through your account dashboard.
The Service is a tool for protecting your traffic and accessing the network. The Service does not promise or guarantee complete anonymity online: anonymity also depends on your device, software, accounts and your own behaviour.
3. Account and access credentials
- you are responsible for the accuracy of the data provided at registration;
- you are responsible for keeping safe your dashboard password as well as the logins, passwords, keys and configuration files of your VPN servers;
- actions performed using your credentials are deemed to be performed by you;
- sharing access with third parties, reselling or jointly using the rented server without the Service's consent is not permitted;
- if you suspect your credentials have been compromised, change them in the dashboard immediately and notify us.
4. Acceptable use: what is prohibited
Your rented server runs on our partners' infrastructure and uses their IP addresses. Violations lead to IP blacklisting, complaints and shutdown of the server. The following is prohibited on the Service's servers:
- any unlawful activity that breaches the laws of the country hosting the server, of your country, or of the country of the service you connect to;
- fraud, deception, phishing and creating phishing resources;
- unauthorised access to other people's systems: hacking, password brute-forcing, port scanning, vulnerability probing (including SQL injection);
- network attacks, including DoS/DDoS, flooding and overloading third-party resources;
- spam of any kind (email, forums, comments, messengers), bulk email campaigns, and any activity likely to place the server's IP address on blacklists (Spamhaus, SpamCop, StopForumSpam, BlockList.de and similar);
- distribution of malware (viruses, trojans, ransomware), operating botnets;
- distribution of material infringing copyright holders' rights (video, music, software, etc.);
- material related to the sexual exploitation of minors — in any form and without exception;
- trade in prohibited goods and services, threats, insults, defamation, incitement to hatred;
- actions that breach the terms of the third-party services you connect to.
If you commit unlawful acts, you bear full personal, administrative and criminal responsibility for them and their consequences.
5. Legality of use
The legal status of VPNs differs between countries. You decide for yourself whether using the Service is permitted in your jurisdiction and you are responsible for complying with the law applicable to you. The Service does not provide legal advice.
6. Disclaimer of warranties ("as is")
The services are provided on an "as is" and "as available" basis. We make reasonable efforts to keep everything running, but we do not guarantee:
- uninterrupted, error-free operation;
- any particular connection speed — it depends on your ISP, device, route and network load;
- compatibility with any specific website, application or service;
- guaranteed circumvention of blocking: filtering methods (including DPI) change, and individual protocols may degrade or stop working on particular networks;
- that third-party services will not restrict your account because your IP address changed.
7. Limitation of liability
The Service is not liable for harm, or the possibility of harm, to the User, their information, equipment or business arising from the use of or inability to use the services, including lost profits, data loss and the blocking of your accounts with third-party services.
8. Suspension and termination of access
The Service may restrict, suspend or terminate access:
- in the event of a breach of these Terms;
- upon justified complaints or requirements from hosting partners, payment providers or competent authorities;
- in the event of actions that threaten the Service's infrastructure or other users.
Where service is terminated for a breach of these Terms, amounts paid are not refunded.
9. Intellectual property
The website, its design, texts, images, source code and signs belong to the Service or are used on lawful grounds. Copying and distributing website materials without permission is not allowed. Third-party open-source software used on the servers is distributed under its own licences.
10. Payment, renewal and refunds
Prices, terms, payment, renewal and refund procedures are described in the Public Offer. A refund is possible where the service was not provided due to technical reasons on our side.
11. Data and logs
We do not keep logs of your VPN traffic: which sites you visit and what you transmit is neither recorded nor stored. The data we do process, retention periods and your rights are described in the Privacy Policy.
12. Changes to these Terms
We may amend these Terms: the current version is always available on this page and the update date is shown at the top. By continuing to use the Service after changes, you accept the new version.
